This Privacy Policy explains how KIM PHU HOLDINGS COMPANY LIMITED ("we," "us," or "our"), a company based in Vietnam, handles information when you use PoseVibe AI (the "App").

PoseVibe AI lets users upload selected images, choose pose or style templates, generate AI-powered video results, save generated video results, and share results through the iOS share sheet.

Information We Process

1. Images You Select

When you use an AI generation feature, you may select an existing image from your photo library for upload. The App does not support taking a photo directly with the camera for upload. We only process the specific image you select for that generation request.

We do not scan, collect, or upload your full photo library. Access to your photo library is controlled by iOS permissions, and you can change those permissions at any time in your device settings.

The image you upload is used only to generate the AI output you request. The original uploaded image is deleted immediately after generation is completed.

2. Generated Content

We store the AI-generated videos created through the App so that you can view, download, share, or manage them later inside the App.

Generated results remain available until:

• You delete a specific generated result in the App; or
• You delete your App account.

Uninstalling the App does not automatically delete your account or your generated results. To delete your account or request deletion of your information, please use the in-app account deletion feature or contact us at [email protected].

3. Account Information from Apple and Google

Some features may require login. If you use Sign in with Apple, Apple may provide us with:

• Your Apple user identifier;
• Your email address, if you choose to share it; or
• A private relay email address, if you use Apple's Hide My Email feature.

If you use Google Sign-In, Google may provide us with:

• Your Google account identifier;
• Your email address; and
• Your profile name or display name, if available.

We use this information only to create and manage your App account, authenticate your login, and associate your generated results and credits with your account.

4. Purchase Information from Apple

The App allows users to purchase credits. Credits can be used for AI generation features inside the App.

All purchases are processed by Apple through the App Store. We do not receive your payment card number, bank account details, or full billing information.

We may receive limited purchase-related information from Apple, such as:

• Confirmation that a purchase was completed;
• Product identifier;
• Transaction status;
• Purchase date;
• Information needed to restore purchases or provide purchased credits.

We use this information only to deliver credits, restore purchases, prevent purchase fraud, and provide support related to purchases.

Face Data

The App does not collect face data.

Images uploaded by users may contain a visible face. However, we do not extract, collect, store, share, or create face data, face templates, face geometry, biometric identifiers, or any information intended to identify a person by their face.

The App processes the entire user-selected image only as needed to generate the requested AI result based on the selected template. We do not separately process, extract, or create face data or facial feature data from the image.

We do not:

• Collect face data;
• Store face data;
• Share face data with third parties;
• Use face data for advertising or analytics;
• Use face data to identify users;
• Use face data to train AI models; or
• Use uploaded images to train unrelated AI models.

The original uploaded image is deleted immediately after generation is completed.

How We Use Information

We use information only as necessary to:

• Provide AI image generation features;
• Process the image you choose to upload;
• Store and display your generated results;
• Manage your account through Sign in with Apple or Google Sign-In;
• Measure app installs, attribution, performance, and usage trends through Adjust;
• Deliver and restore purchased credits;
• Provide customer support;
• Maintain App security and prevent abuse;
• Resolve technical issues; and
• Comply with legal obligations.

We do not use uploaded images, generated results, or account information for advertising or sale of personal information. Adjust analytics are used only for app measurement, attribution, performance analysis, and understanding general usage trends.

How Information Is Shared

We do not sell personal information. We do not share personal information with advertising networks or third-party AI providers.

Information may be shared only in the limited situations below.

Cloud Hosting Providers

We use cloud hosting providers to operate our own AI service, process user-selected images for generation, and store generated results. These providers supply infrastructure only and are not third-party AI generation providers. They are not permitted to use your information for their own advertising, analytics, AI training, or unrelated purposes.

Apple Services

If you use Sign in with Apple or make an in-app purchase, Apple processes information related to authentication, purchases, refunds, purchase restoration, and App Store account management.

Google Services

If you use Google Sign-In, Google processes information related to authentication and Google account management. We receive only the account information needed to authenticate your login and manage your App account.

The Google Sign-In SDK embedded in the App may independently collect device, usage, and authentication-related information as described in Google's privacy policy.

Adjust

We use Adjust SDK to help measure app installs, attribution, app performance, and general usage trends. Adjust may process technical and device-related information such as device identifiers, app activity events, device type, operating system version, country or region, and attribution-related information.

We use Adjust for measurement and analytics only. We do not use Adjust to sell your personal information, and we do not permit Adjust to use uploaded images, generated videos, or account information for its own advertising purposes.

Sharing You Choose

If you choose to save a generated video to your device or share it using the iOS share sheet, the video may be handled by Apple and by the destination app or service you select.

For example, if you share to Instagram or Twitter/X, the destination platform's own privacy policy applies. The App does not integrate Instagram or Twitter/X SDKs; sharing is initiated by you through the iOS share sheet. We do not control how third-party apps or platforms process content after you choose to share it with them.

Legal and Safety Reasons

We may disclose information if we believe it is necessary to:

• Comply with applicable law, legal process, or government requests;
• Enforce our terms or policies;
• Protect the rights, safety, and property of users, us, or others;
• Detect, prevent, or address fraud, security, or technical issues; or
• Respond to an emergency.

Business Transfers

If we are involved in a merger, acquisition, financing, reorganization, sale of assets, or similar transaction, information may be transferred as part of that transaction, subject to appropriate confidentiality protections.

International Data Transfers

KIM PHU HOLDINGS COMPANY LIMITED is located in Vietnam. The App's server infrastructure is located in the United States and uses cloud hosting providers to operate our own AI service and store generated results. These cloud hosting providers provide infrastructure only and are not third-party AI generation providers.

Google and Adjust may process information in countries where they or their service providers operate. If you use the App from outside Vietnam or the United States, your information may be processed in countries that may have data protection laws different from those in your country or region. Where required by law, we use appropriate safeguards for international transfers.

Data Retention

We retain information only for as long as needed for the purposes described in this Privacy Policy.

• Original uploaded images are deleted immediately after generation is completed.
• We do not collect or retain face data.
• Generated results are retained until you delete them or delete your account.
• Apple purchase records related to credits may be retained as needed to provide credits, restore purchases, prevent fraud, respond to support requests, and comply with legal or accounting obligations.
• Account information received through Sign in with Apple or Google Sign-In is retained while your account remains active, unless deletion is required or requested.
• Adjust measurement and attribution data is retained only for the period needed to measure app installs, attribution, app performance, usage trends, security, fraud prevention, and legal compliance, based on our Adjust configuration and applicable legal requirements.

Your Choices and Rights

Depending on your location, you may have rights regarding your information, including the right to:

• Access information associated with your account;
• Request correction of inaccurate information;
• Request deletion of your account and generated results;
• Object to or restrict certain processing;
• Withdraw consent where processing is based on consent;
• Request a copy of your information in a portable format; and
• Lodge a complaint with a data protection authority.

Device Permissions

You can control photo library, notification, and tracking-related permissions through your iOS device settings. If you disable photo library access, you may not be able to select images for AI generation. The App may request App Tracking Transparency permission for Adjust measurement and attribution. If you choose not to allow tracking, tracking-based Adjust functionality is disabled.

Account Deletion

You may delete your account using the in-app deletion feature or by contacting us at [email protected]. Account deletion will remove your account information and generated results from active systems, subject to legal, fraud-prevention, purchase-record, and accounting retention requirements.

Data Security

We use reasonable technical and organizational measures designed to protect information processed through the App. However, no method of transmission or storage is completely secure. We cannot guarantee absolute security.

You are responsible for maintaining the security of your device, Apple ID, Google account, and account access.

Children's Privacy

The App is not directed to children under 13 years old. We do not knowingly collect personal information from children under 13.

If you are located in the European Economic Area, United Kingdom, or another region with a higher age threshold for consent to online services, you must meet the minimum age required by local law or have appropriate parental or guardian consent.

If we learn that we have collected personal information from a child without required consent, we will delete it as required by law. If you believe a child has provided us with information, please contact us at [email protected].

California Privacy Notice

If you are a California resident, you may have rights under the California Consumer Privacy Act, as amended by the California Privacy Rights Act (CCPA/CPRA).

We do not sell personal information, and we do not share personal information for cross-context behavioral advertising.

Depending on how you use the App, we may process the following categories of personal information:

• Identifiers, such as Apple user identifier or email address provided through Sign in with Apple, Google account identifier or email address provided through Google Sign-In, or device identifiers;
• Commercial information, such as credit purchase status received from Apple;
• Internet or other electronic network activity information, such as app activity events and attribution-related information processed through Adjust;
• Visual information, limited to the image you choose to upload and the generated video result; and
• Account-related information needed to provide credits and generated results.

California residents may request access, deletion, correction, and information about our data practices by contacting us at [email protected].

European and UK Users

If you are located in the European Economic Area or the United Kingdom, the legal bases for our processing may include:

• Performance of a contract: to provide the App, generate requested content, manage your account, and deliver purchased credits;
• Consent: for optional permissions such as photo library, notifications, and tracking-related permissions, where required;
• Legitimate interests: to maintain security, prevent abuse, resolve technical issues, provide support, measure app performance, understand general usage trends, and improve the App; and
• Legal obligations: to comply with applicable laws, accounting requirements, and lawful requests.

You may have rights to access, correct, delete, restrict, or object to processing of your information, and to request data portability. You may also have the right to lodge a complaint with your local data protection authority.

Changes to This Privacy Policy

We may update this Privacy Policy from time to time. If we make material changes, we will update the effective date above and may provide additional notice in the App where required by law.
